I bought land through a nominee. Is that legal?
No — and it never was, even before the new Bali rules. Agrarian law voids any arrangement that directly or indirectly transfers freehold to a foreigner: the deal is void by law, the land falls to the State, and — the sentence every promoter hopes you never read — payments you have made cannot be reclaimed. The Supreme Court has treated nominee constructions as evasion of law, and the courts protect whoever is on the certificate.

Do the new Bali rules make me a criminal now?
No — and precision matters here. Bali's provincial rules expressly PROHIBIT nominee land transfers, including acting as an intermediary or facilitator, but the sanctions within that rule are administrative: warnings, closure, licence revocation. Criminal exposure, where it exists, runs through national law — not through the provincial rule. The practical point is different: the province is now actively hostile to these structures, notaries increasingly refuse the deeds, and the civil position was already fatal — void from day one.

Can I get my money back?
The starting point in the rules is against you: the same sentence that voids the deal says payments received by the owner cannot be reclaimed. Particular facts sometimes open other doors — claims against brokers or facilitators, deceit-based routes, a negotiated exit — but that is case-specific analysis, and anyone promising your money back as a standard outcome is selling you a second story of the same quality.

My nominee is family or a trusted friend. Still a problem?
Yes, because the main risk is not betrayal — it is life. Your nominee's death puts 'your' land into their estate; their divorce puts it into a marital property fight; their debts expose it to their creditors, because the law makes all of a person's assets security for their obligations. Against every one of those events you hold no enforceable right at all. Trust does not fix a void structure; structure does.

What are the lawful ways out?
Convert the position into what the law actually gives foreigners: hak pakai if you are resident here; dwelling ownership within its limits; a properly drafted and provable long lease; a right to build through a PT PMA where a genuine business exists — or an orderly sale while relations are still good.

Can a nominee agreement just be made stronger instead?
No. No drafting can make a void cause valid: a 'stronger' nominee agreement is simply better evidence of the violation. Anyone offering to strengthen one is selling you a larger risk in a more convincing wrapper.
