Can a foreigner own land or a villa in Bali?

Not freehold — freehold title is reserved to Indonesian citizens, and no workaround for that survives a courtroom. What foreigners genuinely do have: a properly papered lease; hak pakai, a registered land right for foreigners resident in Indonesia; ownership of a dwelling within set limits; or a right to build through a PT PMA where there is a genuine business. Which route fits depends on your residence status, use and horizon — that is a structuring decision, not a form.

Is a 25-year lease actually safe? What if the owner sells — or dies?

Those two fears are the two things the civil law answers in the tenant's favour: a sale of the property does not break a prior lease, and the owner's death does not end it — it binds the heirs. What actually kills long leases is proof and drafting: an unsigned scan, the wrong signatory, no renewal mechanics, unclear land status underneath. A notarial deed proves itself; a WhatsApp PDF does not.

Is there a legal maximum for lease length?

No — and we checked the absence ourselves: the lease chapter of the civil law contains no duration cap. The 25–30 year figures circulating in Bali are market practice, plus confusion with the durations of hak pakai, which is a different right. Length is negotiable; what needs securing is enforceability.

My lease is in English only. Is that a problem?

With an Indonesian lessor, yes — the language rules require an Indonesian text for agreements involving Indonesian parties. Since the Supreme Court's 2023 guidance, a missing translation alone no longer voids a contract without bad faith — but why hand your counterparty the argument at all? The fix is cheap: a bilingual restatement signed before any dispute, with the prevailing language expressly stated.

What should be checked before I pay for a villa?

Before any money moves is the only useful time: the certificate and the actual owner — is the person leasing to you the person on the title? Then the land status under the deal, the zoning, the building approvals, tax arrears, and any nominee shadows in the ownership chain. A void link stays void no matter how many hands it passes through afterwards.

I want to rent my villa out. What licence do I need?

Villa rental has its own business code — not the pondok wisata code, which is an owner-occupied home and is often wrongly used. The wrong code means the wrong licence, and it surfaces exactly when you least want it: at a complaint, at a sale, or at an inspection. The licence chain and the Bali overlay depend on the risk level; foreign eligibility is checked per code.
